When Activision merged with Vivendi, it was thought that the rights to the heavy metal action adventure title, Brutal Legend, were dropped, allowing Electronic Arts to pick up the title and publish it. Although this now appears to be incorrect, as Activision has written a letter to EA informing them about negotiations with Double Fine, which jeopardizes the agreement EA had with Double Fine.
A EA Spokesperson told GI.Biz, ”We doubt that Activision would try to sue, that would be like a husband abandoning his family and then suing after his wife meets a better looking guy.”
Activision recently sold the Ghostbusters video game rights to Atari, and it’s likely they will be looking to follow a similar pattern with the Brutal Legend rights.
