A joint statement from both publishers simply stated, ”Activision and EA have agreed to put this matter behind them.”
The settlement happened soon after Activision hired a new lawyer, Beth Wilkinson, to represent them. Her first motion was to delay the trial by 30 days, When the request was denied by California Superior Court judge Elihu Berle, Wilkinson moved ahead with an out of court settlement worked out with Electronic Arts.
Earlier this week, Activision paid the ex-Infinity Ward staff $42M in royalties for Modern Warfare 2.
However, there’s still more legal entanglement on the horizon, as West and Zampella are still taking legal action against Activision for wrongful termination, which will be held on the 29th May.
