A class action suit filed September 22nd with the northern California District Court is asking for a judgment in excess of $5 million from Electronic Arts. The suit was filed by one Melissa Thomas and “all others similarly situated.” The complaint sites that the installation of SecureROM as part of the Spore installation was not authorized by the Plaintiff and that SecureROM can have undesired effects on the consumer. Part of the complaint states, “SecureROM is an entirely separate, stand-alone program which will download, install, and operation on their computers, along with the Spore download. Consumers are given no control, rights, or options over SecureROM. The program is uninstallable. Once installed, it becomes a permanent part of the consumer’s software portfolio. Even if the consumer uninstalls Spore, and entirely deletes it from their computer, Secure ROM remains a fixture in their computer unless and until the consumer completely wipes their hard drive through reformatting or replacement of the drive.”
